En liten skitsak bara..?

I nyheten på polisens hemsida går att läsa bland annat detta:
I immaterialrättens område ingår bland annat upphovsrätt, patenträtt, mönsterrätt och varumärkesrätt. Varumärkesintrång och fildelning är exempel på brott.
Varpå vän av ordning naturligtvis måste påpeka att “Nej, det är det inte alls det.”
Fildelning är inte ett brott! Att fildela upphovsrättsskyddat material utan upphovsrättsinnehavarens tillåtelse – det som till vardags brukar kallas “illegal fildelning” – är däremot ett brott.
Det låter kanske som ordmärkeri, bara tröttsamt pladder från en språkfascist. Men det finns faktiskt några verkliga anledningar till att jag överhuvudtaget orkade sätta mig och skriva det här inlägget.
För det första så tycker jag att man ska kunna kräva av myndighetsutövare att de ska veta vad de sysslar med.
Ett språkbruk som antyder något annat är inte acceptabelt, då det skadar förtroendet för myndigheter i allmänhet och (i det här fallet) rättsväsendet i synnerhet. Hade nyheten handlat om trafikpolisen hade det kunnat heta att “Fortkörning och att äga en bil när man är full är exempel på brott” eller nåt. Låter det kompetent och förtroendeingivande?
För det andra så är det faktiskt viktigt att påminna om den här distinktionen, skillnaden mellan fildelning som teknologi och fildelning som metod för att sprida eller tillgodogöra sig upphovsrättsskyddat material utan tillåtelse.
Fildelningen som teknologi är ett extremt viktigt fenomen rent sociokulturellt, men även teknologiskt. När fildelning börjar betraktas som illegalt i sig så får det konsekvensen att makthavare – i sammanhanget alltså internetoperatörer, politiker, med flera – vill börja motarbeta tekniken i sig. Vi har redan sett exempel på det – googla “bittorrent throttling” så får du en liten försmak.
Problemet med den typen av aktiviteter är inte bara att det är en smärre katastrof för många mindre artister, filmskapare och författare som använder tekniken för att nå ut till en större målgrupp, utan även att det omöjliggör tjänster som mediafavoriterna Spotify och Voddler, som ju båda bygger på fildelningsteknologi under skalet.
Alltså:
Skärp er, Polismyndigheten i Stockholms län!

certainly like your web site however you have to check the spelling on several of your posts. A number of them are rife with spelling issues and I find it very bothersome to tell the truth then again I’ll definitely come back again.
