Nu är jag inte någon fildelare av rang precis. Men om jag hade velat så hade jag alltså kunnat stå utanför på gångvägen och fildelat på 10 andra personers IP-nummer! Enligt IPRED-lagen skulle då ifpi kunna skicka skadeståndsbrev hem till dessa helt oskyldiga personer. De betalar förvisso abonnemanget, men det går inte att säga vem som använt nätet. Det kan vara vem som helst. Tänk hyreshus.
Är det rätt? Vad tycker justitieministern? Blir IPRED en bra lag?
♦ IPRED-diskussionen borde inte handla om fildelning. Josh skriver om att fokus borde flyttas tillbaka till det som är det verkligt viktiga med IPRED:

Hela konceptet bygger alltså på att båda parter i grund har ungefär samma möjligheter inför domstolen, rubbas den balansen rubbas också hela grunden för ett rimligt utfall. Det är ett strålande koncept mellan privatpersoner, eller mellan företag, där man är förhållandevis jämnstark.
IPRED kommer i praktiken ställa enskilda människor med normal ekonomi inför situationen att hamna i tvist mot en branschorganisation. Det är alltså inte ens en person mot ett företag, utan en person mot en organisation som företräder en hel nisch av marknaden. Det är David mot Goliat, när David glömt sin slunga hemma.
De har så klart rätt båda två. Samtidigt tror jag att det kan föra med sig något positivt att fildelningsdebatten är på tapeten igen. Till exempel har Moderata Ungdomsförbundet nu officiellt tagit ställning för icke-kommersiell fildelning, och det borde väl bara vara en tidsfråga innan de andra ungdomsförbunden följer efter?
