♦ Mattias Bjärnemalm är förbundsordförande i Piratpartiets ungdomsförbund, Ung Pirat, och har så klart en blogg. På den skriver han förståndiga saker. I förrgår skrev han om Uppsala Nya Tidning, som också verkar ha förstått en del. Det är skönt att se att det finns människor som kan först lyssna på argument och sedan begripa det de hör:
Invändingarna måste tas på allvar. Integritet, myndighetsutövning och bevisbörda är frågor som inte bara kan sopas åt sidan. För regeringen gäller det att verkligen lyssna, och inse att det här inte är en fråga man kan lösa med några enkla formuleringar. För faktum är att IPRED vilar på i grunden felaktiga föreställningar.
♦ Madeleine Sjöstedt (fp) skriver i Aftonbladet att framtiden tillhör fildelarna. Jag misstänker att just den formuleringen är mer rubriksättarens än hennes egen i och för sig, men debattinlägget är ändå full av sund inställning:
Utgångspunkten ska inte vara hur man kan förhindra fildelning, utan hur man kan skapa en lagstiftning som både gynnar den kulturexplosion som fildelningen innebär, samtidigt som man skyddar upphovsmännens intressen. Även med ett kort historiskt perspektiv är det svårt att förstå varför det skulle vara omöjligt.
♦ Som jag skrev om häromdagen så finns det numera fler artister som uttalar sig positivt om fildelningens möjligheter än vad jag kan hålla reda på. En av dem är Jonas Almquist, vars band The Leather Nun var stora under 80-talet. Han skriver att de aldrig hade tjänat en spänn på IPRED:
Jag törs påstå att majoriteten av alla svenska band som idag turnerar i Europa och USA, gör det inte för att skivorna säljer utan för att fildelning, olaglig nedladdning och Internet-communities som MySpace och Soundclick fungerar som gigantiska marknadsföringsmotorer. Måhända förlorar vi ören i STIM-pengar, men vi vinner kronor på turnéinkomster.
♦ Rick Falkvinge, ordförande för Piratpartiet om någon missat det, uttalar sig i SvD angående det så kallade “förmildrandet” av IPRED-förslaget. Han tycker det är självklart att lagstiftning inte ska kunna gälla retroaktivt:
– Du går mot röd gubbe idag, och du vet att det är olagligt, sedan kommer det en lag om tre år som säger att alla som gått mot röd gubbe ska straffas med 100 000 kronor. Man kan inte göra så, säger han.
♦ Expressens ledarsida är inne på samma linje:
Den som laddar ner upphovsrättsskyddat material innan lagen träder i kraft ska inte omfattas av den. Det borde vara en självklarhet. Retroaktiv lagstiftning hör inte hemma i ett rättssamhälle. Det är förstås bra att justitieministern nåtts av den insikten.
Men det räcker inte. Den föreslagna lagen borde inte gälla alls.

Upphovsrätten måste värnas men inte på bekostnad av rättssäkerheten. Skivbolagen väljer helt fel väg när de försöker stävja illegal fildelning genom jaga nätanvändarna. I stället borde de utveckla attraktiva, legala fildelningstjänster. Bara så kommer upphovsrättsbrotten att kunna minska.
Det enda rimliga sättet att “mildra” lagförslaget är att skivbolagen inte ges rätt att agera privatpoliser.
♦ Niklas Wykman är ordförande i Moderata Ungdomsförbundet (skulle inte han avgå om Moderaterna inte backade i FRA-frågan förresten?) och uttalar sig i SvD:
- Det här ju en halvmessyr, och snömos i jämförelse med vad som skulle behövas. Det som är positivt är att man kan tänka sig en reträtt, men att tro att det här är tillräckligt är att grovt underskatta oss som inte tycker att den här lagen är bra.
♦ Monty Python har förstått vad som krävs för att möta framtiden:

Professor Charles Nesson på Harvard ger sig in i fildelningsstriden genom att förklara att skivbolagens skadeståndskrav bryter mot den amerikanska konstitutionen. Jag gör ett försök att fritt översätta hans argument nedan:
Tänk er en lag som, för att avskräcka, kräver böter på 750 dollar för varje kilometer-per-timme som föraren överskrider hastighetsbegränsningen, och att böterna ökar till 150,000 per kilometer för fort om föraren visste att han eller hon körde för fort. Tänk dig att de här böterna inte offentliggörs, och att de flesta förare inte vet att de finns. Tänk dig att indrivandet av de här böterna hanteras av en privat poliskår med egenintresse, som inte kan hållas ansvarig, som kan välja sina mål efter eget gottfinnande, som kan ta emot eller avvisa mutor för att inte dra ärenden till åtal, och som stoppar alla böter i egen ficka. Tänk er att en stor andel av de här böterna aldrig bestrids, oavsett om de är korrekta eller inte, eftersom de personer som stämts har begränsade resurser och inte vet om de har en chans inför en objektiv jury.

Det här är alltså en beskrivning av situationen från en person som är professor i juridik vid Harvard. Det är svårt att ha bättre renommé än så. Det här är vad skivbolagen gör i USA, och som regeringen tycker att de ska få göra här, för att hålla de 37 samt en skröplig och otidsenlig bransch vid liv. I artikeln i GP erkänner Fru Justitia, Beatrice Ask, att hon inte kan garantera att bolagen kommer att låta bli det här beteendet i Sverige. Med andra ord kan vi vara rätt säkra på att det kommer att bli så. Företrädare för skivbranschen har redan sagt att de inte tänker ge sig efter enbart de “stora fildelarna”, vad de nu menar med stora. Ask påpekar också att vi inte har så våldsamma skadeståndssummor i det här landet, eftersom vi har en annan juridisk tradition, men hon tiger om att det är just den traditionen som den här lagen vänder upp och ned på.
